The Freedom of expression in Brazilian democracy

Synopsis

The aim of this paper is to make a reflexive analysis about the limits of freedom of expression in Brazilian democracy. In this sense, the study examines the social and legal definition of freedom of expression, the importance of freedom of expression for the Brazilian press, to what extent the use of the right to freedom of expression to deliver a hate speech can affect Brazilian democracy and finally, it aims to propose which measures should be adopted to ensure freedom of expression for the press. Finally, it was concluded that the exercise of freedom of expression should be considered, as the exercise of that right can bring damages that can be repaired. Furthermore, the State must have more stringent measures to combat fakes news, since the employees currently employed are not enough. The methodological path adopted a qualitative approach, based on bibliographic research based on doctrines, jurisprudence, scientific articles and works published on the theme. In addition, the methods applied will be hypothetical-eductive and comparative.
