The right to the recognition of paternity and its importance in view of the principle of human dignity

The recognition of paternity is something that makes a big difference in people's lives. Directly impacting life and is related to some principles listed in the Brazilian Constitution. This was not always a right, where children born out of an extramarital relationship did not have the same rights as those considered “legitimate”. What implies in succession issues and above all, can cause psychological problems that can damage, for example, the relationships of this individual in their environment. This research aims to analyze the right to the recognition of paternity, given the Principle of Dignity of the human person. It intends to verify some of its historical, legal and social aspects. We currently have different forms of families in our society. So the need to talk about the subject is latent. The methodology adopted for the development of the study was the Bibliographic and Documental Review, adopting works by renowned authors who focus on the theme such as: MINUCHIN (1990); GONÇALVES (2009); DINIZ (2012). Jurisprudential understandings, scientific articles, theses and monographs already published on the subject were also used. The survey of such material took place through internet research using keywords such as: Recognition of paternity; Principle of Human Dignity; Affiliation; Family law. Through which we conclude that this is a matter of paramount importance and social interest.
