Synopsis

This study sought to understand the use of socio-educational measures in Brazil, which is a complex issue that involves economic, social, family and educational issues, seeking to reflect possible interventions with a view to minimizing this situation through the prevention of crime. Its general objective was to address the criminal liability of adolescent offenders that occurs through socio-educational measures and then try to clarify the reasons for the recidivism of minors. In the discussion of results, the rights of children and adolescents were analyzed, based on the creation of the Child and Adolescent Statute (ECA), and also the creation of SINASE as a mechanism for implementing socio-educational measures. Despite all this legal apparatus, the scarcity of social policies and programs capable of re-educating and re-socializing adolescent offenders is clear, in addition to the absence of the family in this process. The methodology used was a bibliographic research, as it was based on a bibliographic survey of research in electronic journals and periodicals inserted in the Scielo virtual library, electronic journals and Google Academic. It is concluded that the doctrine of full protection provided for in the ECA is not fully implemented. The effectiveness of socio-educational measures, in relation to the offender, will depend on resources that enable the implementation of the measures and that provide pedagogical conditions for their reintegration into the social environment, requiring the implementation of public policies that guarantee them food, education, health, culture, leisure, profession, allied to the commitment of everyone involved in the reality of this minor offender.
