The possibility of applying the principle of insignificance by the police authority

This paper aims to analyze the possibility of applying the Principle of Insignificance by the Police Chief in the area of police investigation. To achieve this objective, a bibliographic research, articles from relevant doctrinal literature, jurisprudential research and Brazilian legislation were carried out. The principle of insignificance operates with the intention of restricting the interpretation of the penal type, in order to exclude the material typicality of the punishable conduct. The methodological approach of this article is qualitative and will make use of the research in a descriptive way, in order to identify the main objective of the referred article on the possibility of the police authority applying the aforementioned principle in concrete cases that admit the use of power discretion of the Chief of Police. Finally, it can be seen that the Police Chief, in extension of his constitutional function, has a legal duty to analyze, also, the material scope that integrates the criminal types.
