Violation of the principle of efficiency: excess of laws versus ineffectiveness and inapplicability

Synopsis

This article presents a theoretical discussion of the problem of legislative management in the Federal,
State and Municipal spheres, with a bias towards conflicts of competence in the creation of laws that
regulate the Brazilian legal system and thus violate the principle of efficiency in public
administration. In this context, after research carried out, we found that Belo Horizonte, in order to
regulate the inspection of irregular passenger transport (TIP), currently has in force the federal
law No. 9503, of September 23, 1997, which institutes the Brazilian Traffic Code (CTB ), state law
19,445, of January 11, 2011, which establishes rules to curb the illegal metropolitan and
inter-municipal transport of passengers in the State of Minas Gerais. And municipal law No. 10,309,
of November 21, 2011, which was regulated by Decree No. 16,195 of January 7, 2016, which establishes
rules to curb economic activity that consists of clandestine or irregular passenger transport in the
Municipality of Belo Horizonte .
